The Constitutional Court of Ukraine (CCU) declared the creation of the National Commission for State Regulation in the Fields of Energy and Utilities (NERCEP) unconstitutional. This means that all decisions made by this commission in setting utility tariffs were illegal, said Mykola Katerynchuk, representative of the Civic Position.

“On August 27, 2014, when Ilovaysk tragedy took place, Poroshenko by his decree created a National Commission for State Regulation of Energy and Utilities, appointing Vovk from his Roshen company to the post of its Chairman. Think what about Poroshenko thoughts when the real hell was in the east of Ukraine! For five years, the Commission has plundered the budget of Ukraine, served the interests of oligarchic groups, implemented Rotterdam +, and pocketed every Ukrainian family. Poroshenko appointed and dismissed the commission members individually. And for all five years the parliament, the government, the courts, which should have stop Poroshenko, pretended that everything was normal”, said Mykola Katerynchuk.

The CCU believes that Poroshenko acted beyond his powers. This means that all decisions made by the Commission on tariffs are illegal. According to Katerynchuk, President Zelensky, the new parliament and the government will finally be able to resolve the issue of fair utility tariffs for Ukraine. And Poroshenko and his crime partners must bear not only political but also criminal responsibility for this crime.
