Mykola Katerynchuk asks the court to acknowledge the actions of the Parliament on January 16, 2014 as illegal and to stop the publication of the anti-democratic laws

The People`s Deputy of Ukraine, the leader of the European Party of Ukraine Mykola Katerynchuk appealed to the Supreme Administrative Court of Ukraine and asked the court to acknowledge the actions of the Verkhovna Rada of Ukraine, concerning voting of the anti-democratic laws at a plenary meeting on January 16, 2014 as illegal. In another lawsuit he asks the court to stop the publication of these laws in media.
“According to the Article 75 of the Constitution of Ukraine, a sole body of legislative power in Ukraine is Parliament – the Verkhovna Rada of Ukraine. The 5th Part of Article 82 of the Constitution of Ukraine states that the working arrangements of the Verkhovna Rada of Ukraine are set by the Constitution of Ukraine and the Law on the Regulations of the Verkhovna Rada of Ukraine. The Respondent’s actions during the voting of the above laws were a direct breach of the Regulations, and therefore are illegal”, – is said in the lawsuit.
Mykola Katerynchuk specifically indicates that it was not necessary to carry out voting by raising hands, because the technical equipment was working properly; in violation of the Law on the Regulations of the Verkhovna Rada of Ukraine the voting was carried out simultaneously as a basis and as a whole; the integration of issues for the voting was carried out alternately, while, according to the Law, this procedure must be carried out before the beginning of the plenary meeting; the Parliament did not make a decision about a short discussion of the above laws; there was no the decision of relevant committees for a number of laws, etc.
Mykola Katerynchuk emphasizes that these actions were a violation of his rights as a People’s Deputy of Ukraine, which are provided by the Law of Ukraine “On the Status of People’s Deputy of Ukraine”, namely to participate in the debate, to question the speakers and the head of the plenary meeting, to come up with justification of proposals and in explanation of vote, to express opinions on each matter considered at the meeting.
