Mykola Katerynchuk asks VASU to declare the meeting of the parliament on Bankova St. outlaw

Today, on April 5th, 2013 the Deputy of Ukraine Mykola Katerynchuk, the leader of the European Party of Ukraine, applied to the Supreme Administrative Court of Ukraine for recognition of the illegal acts of the Verkhovna Rada of Ukraine on the April 4th plenary session in the another place than the parliament building on Hrushevskoho St. 5. 

In particular Mykola Katerynchuk states that the Article 2 of the ASE Regulation allows the meeting in another place, but a decision on this should be accepted by the Parliament and it should be issued by the relevant resolution. “However, according to the Chairman of the Verkhovna Rada Volodymyr Rybak, the decision to hold a plenary session at the Parliamentary Committee in the Presidential Administration was not adopted by the Parliament but by the “the meeting of Deputies” from the Party of Region, the Communist Party and some independents MPs. Therefore, an authorized subject – “the meeting Deputies” assumed those powers that are within the competence of the Parliament. In this manner, the meeting of the Parliament can be held anywhere, not even necessarily in Ukraine, and it can adopt any decision. Thus, there is an evidence of the power usurpation, “- said the plaintiff.

“Actions of the Parliament have deprived the opportunity to exercise my right as the MP, which is set and guaranteed by the Constitution and the law “On the Status of People’s Deputies of Ukraine “, and also deprived the opportunity to carry out my duties as the Deputy of Ukraine. Moreover, the legally significant decisions and laws were adopted at this session of the Parliament. Thus, the court should declare this meeting of the Parliament outlaw”, – said Mykola Katerynchuk.
