On May 8 the European Court of Human Rights (ECHR) dismissed the appeal of Ukraine against the judgment in the case of Oleksandr Volkov. Thus, Ukraine is obliged to enforce the judgment, taken on January 9 this year, which determined to reinstate Judge Oleksandr Volkov.

The leader of the European Party of Ukraine, the member of the parliamentary faction “Batkivshchina” Mykola Katerynchuk believes that Parliament will immediately adopt a resolution “On the Implementation of Decisions of the European Court of Human Rights in the Case no. 21722/11 “Oleksandr Volkov v. Ukraine”. The draft resolution was introduced to Parliament on April 16 by the leader of the European Party of Ukraine. The European Court of Human Rights found that “Oleksandr Volkov was dismissed as a Judge of the Supreme Court of Ukraine in violation of fundamental principles of procedural fairness under Article 6 of the European Convention on Human Rights and Fundamental Freedoms” and in violation of the requirements of law within the meaning of Article 8. The European Court of Human Rights determined Volkov`s dismissal with the disregard of the Convention principles as a threat to the independence of the judiciary system in general.

According to Mykola Katerynchuk, the enforcement of the European Court decision must be considered after having repealed the Resolution of the Verkhovna Rada of Ukraine on dismissal of judges of June 17, 2010 and the High Council of Justice refusal to determine Oleksandr Volkov being dismissed for violation of the oath. “The decision must be adopted at the next plenary session of the Verkhovna Rada of Ukraine,” – said People`s Deputy of Ukraine.
