“People who are now in the Kyiv City State Administration, do not violate the current Law of Ukraine”, – commented the leader of the European Party of Ukraine, People’s deputy of Ukraine Mykola Katerynchuk on the possibility of layoffs of the KCSA premises by security forces. – “So laying off the building from someone just does not make any sense. It is not occupied. The KCSA officials are able to freely perform their duties”.
“The Universal Declaration of Human Rights in Article 21 states that everyone has the right to take part in governing of his country, directly or through chosen representatives. The Law of Ukraine “On Local Self-Government in Ukraine” states that local governing may be directly realized by territorial community. In addition, according to the second paragraph of Article 75 of the Law of Ukraine “On Local Self-Government in Ukraine” local community at any time may terminate the powers of authorities and local government officials if they violate the Constitution or the Law of Ukraine, limit rights and freedoms of citizens and do not provide the implementation of the powers granted to them by law”, – said Mykola Katerynchuk. – “So, if the Kyiv City Council is illegitimate according to the Constitution of Ukraine, local community of the city has the right to manage municipal property, including the building of the City Council. Therefore actions of Kyiv citizens who reside in the Kyiv City Council are totally legal and justified”.
“Arrangement and work of public receptions of People`s Deputies are logical and reasonable. The Law of Ukraine “On the Status of People’s Deputy of Ukraine” states that People`s Deputy of Ukraine is elected as a representative of Ukrainian people and authorized during the period of parliamentary powers to implement the powers, provided by the Constitution of Ukraine and the Law of Ukraine. Local state administrations, local governments and their officials are obliged to support the organization of meetings of People`s Deputies with the electorate”, – said Mykola Katerynchuk.
“Therefore, the public receptions of People’s Deputies of Ukraine were organized to ensure the regime of law and order and to prevent violation of the rights and freedoms in the Kyiv City Council. Every citizen of Ukraine can ask for help and his words will be truly heard”, – added People`s Deputy. – “However, it must be noted that there was no interference in the day-to-day work of the Kyiv City Council officials. Documents, equipment, printing, boxes are remained in private offices of the officials. Therefore, people reside in KCSA without violations of Labor Law or the Law of Ukraine “On Local Self-Government in Ukraine”.
