Today, on July 19, 2013 People`s Deputy of Ukraine, the leader of the European Party of Ukraine Mykola Katerynchuk registered in the Parliament the Draft Law of Ukraine that would expand the limits of self-defence (reg.no. 2621 of July 19, 2013 ).
Mykola Katerynchuk proposes an amendment to Article 36 of the Criminal Code of Ukraine that would expand the limits of self-defense. According to the author of the draft law, the necessity to introduce the rule has long been discussed in the media and it is actively supported by Ukrainians. “The law-abiding citizen of Ukraine is still bounded by the limits of self-defence. However, the Criminal Code of Ukraine does not consider that criminals are not bounded by anything, “- is said in the explanatory note.
This draft law proposes to expand the limits of self-defense in cases when the real or personal property of a citizen is illegally penetrated by the unknown person, who threatens some form of violence against him or his family – from murder to rape of his wife and children.
This draft law proposes to give citizens of Ukraine the right to protect their lives and the lives of their relatives, as well as third parties from any sort of criminal assault. This practice takes place in the United States, the UK, and several other countries. Thus people to defend their property are provided not only the right to use violence against offenders, but also the right to apply to “deadly violence”, which means the usage of weapon against the offender up until his death. Such practice seems appropriate to be extended in Ukraine.
The draft law proposes a new edition of the fifth part of Article 36 of the Criminal Code of Ukraine, which expands the limits of self-defense and does not entail criminal liability of a person, who use a weapon or any other means or objects that are directed to protect himself and members of his family or close relatives determined by law , as well as third parties, against violence or threats of violence or to protect property against a person or group of people who illegally penetrated his home or other property , regardless of the severity of the harm caused against the offender.
