Today, the European Party of Ukraine registered a petition in the District Administrative Court of Kyiv, which requests to prohibit the Communist Party of Ukraine to organize and conduct a meeting of citizens of Ukraine to hold a referendum under the public initiative on Ukraine’s accession to Customs Union.
As you know, on August 16, 2013 the Central Election Commission was informed about the meeting of citizens of Ukraine devoted to the referendum under the public initiative on Ukraine’s accession to Customs Union, organized by the Communist Party of Ukraine. They intend to conduct this meeting on September 8, 2013.
“According to the Law of Ukraine “On the Foundations of Domestic and Foreign Policy”, the fundamental principles of foreign policy, in particular Ukraine’s integration into European political, economic and legal space for Ukraine`s membership in the European Union (EU ),”–is said in the statement.-“On February 22, 2013 Verkhovna Rada of Ukraine adopted the Declaration “On the implementation of the European aspirations of Ukraine and signing the Association Agreement between Ukraine and the European Union”. The document states that the European perspective of Ukraine has become a unifying factor, which consolidates the vast majority of political forces. According to this, Parliament stated that, within its powers, he would ensure compliance with the recommendations of the signing of the Association Agreement between Ukraine and the EU, contained in the resolutions of the European Parliament and the Council Conclusions, approved on December 10, 2012 at the meeting of foreign ministers of the EU member states. Thus, Verkhovna Rada of Ukraine within its powers, provided by the Constitution of Ukraine, declared the European integration of the country, further signing of the Association Agreement with the EU and Ukraine`s accession to the EU as a priority direction of Ukraine’s foreign policy.
“According to the European Party of Ukraine, the Communist Party of Ukraine, conducting the national referendum on Ukraine’s accession to Customs Union, violates the current legislation of Ukraine and its actions should be considered unlawful.
According to the Administrative Procedure Code of Ukraine, the task of the administrative proceedings is to protect rights and interests of legal entities in the field of public relations. The statute of the European Party of Ukraine declares that its main purpose is to participate in the construction of Ukraine in the free, democratic, legal and equitable society, and to promote the integration of Ukraine into the EU.
“Illegal actions of the Defendants not only contradict the Constitution, the laws and regulations of Ukraine, but also violate the interests of the Plaintiff in the field of public law for further EU integration of Ukraine. Therefore, Plaintiff has the right for judicial protection of his interests by the administrative appeal”, – is said in the statement.
According to the above arguments, the European Party of Ukraine asks to consider the actions of the Central Election Commission to adopt and record the appeal of the Communist Party of Ukraine about conducting the meeting of citizens of Ukraine devoted to the referendum under the public initiative on Ukraine’s accession to Customs Union on September 8, 2013 as unlawful and the actions of the Communist Party of Ukraine concerning the meeting of citizens of Ukraine to support the referendum under the public initiative on Ukraine’s accession to Customs Union thereto.
