“After the Revolution of Dignity, the question on the restoration of public confidence in the authorities rose acutely. The laws “On the restoration of confidence in the judiciary in Ukraine”, “On removing the government”, and others were adopted. This involves the recruitment of the newly prosecuting authorities on the basis of open and transparent tender procedures. However, the appointment of Shokin dispelled the hopes for quick results in the prosecution reform, “- wrote Ruslan Chernolutsky, the Chairman of the Odessa regional organization of the European Party of Ukraine, in his blog – “The system began to resist reformers at the stage of organizing and conducting the competitive selection. The whole process of creating an “updated” local prosecutor’s office turned into a shuffle of the old prosecution deck. In addition, a trail of corruption and abuse stretches behind many of this deck”.
Ruslan Chernolutsky considers the reformation of the regional prosecutor’s offices nothing but a farce. “Reformation of the regional prosecutor’s offices is a farce rather than the reform. Out of current 638 district prosecutors, 178 local ones were created through the merger. The same corrupt system retains. Out of 930 candidates – the new people make up only 16% in the system. Taking into account Kasko`s opinion, who is the ex-Deputy of Prosecutor General, behind the reformed body hides the same political guardianship, direct and total pressure on investigators and prosecutors, the intentional professional degradation”, – wrote the lawyer.
According to the Chairman of the Odessa regional organization organization, “the problem hides in the fact that the Ukrainian legislator is unable to determine the place of a prosecution in the system of separation of powers”. “The reason is that the place of prosecutors in the system of government is not stated in the Constitution of Ukraine. Having gained independence, Ukraine has not been able to get rid of the most odious features of the totalitarian Soviet system, especially regarding the place and function of prosecution and has transferred them to the new socio-political time and conditions”, – insists Ruslan Chernolutsky.
